The Ombudsman
- is responsible for accepting tips from MAN Group employees concerning illegal actions by MAN Group employees or MAN Group companies. Such tips cannot be made anonymously to the Ombudsman, but can be forwarded anonymously if the employee so desires;
- does not have the function of a complaint department according to the German Allgemeine Gleichbehandlungsgesetz;
- first checks the tip for plausibility (“first verification process”) and then carefully evaluates plausible tips further (“second verification process”) before deciding on how to proceed. During the second verification process, the Ombudsman must consider the credibility of the tip, the credibility of the employee making the tip, the type and severity of the illegal action as well as any effects on other persons. In the course of the second verification process, the Ombudsman should hold a personal meeting with the employee who has provided the information;
- forwards information confirmed in the secondary investigation to the MAN SE Compliance Board, or at his discretion to the MAN SE CEO or Chairperson of the Review Board of the MAN SE Supervisory Board as well;
- after completing the investigation, informs the employee who originally made the tip whether he has forwarded this information to the internal position at MAN. In addition, at the appropriate time, he informs the employee as to the results reached by those internal positions as well as how these results were reached. When providing the employee with this information, the Ombudsman takes into consideration the legitimate interests of all concerned;
- only names the employee who has provided the tip if this person expressly permits it;
- maintains absolute secrecy in regard to third parties as well as government agencies, even after termination
